The Bunker Oil Convention establishes a liability and compensation regime to apply in cases of pollution damage following the escape or discharge of bunker oil from a ship that is not an oil tanker. The Act prescribes that shipowners are strictly liable for pollution damage resulting from the escape or discharge of bunker oil from their ships. Shipowners can limit liability depending on the size of the ship. The Act also gives persons suffering pollution damage a right of direct action against the insurer.
