Resumen This Act lays down provisions on civil remedies for the prevention of the act of unfair competition and for the recovery of damages for injury suffered as a result of the unfair competition in Section 3; acts of unfair competition in Section 4; confusion with respect to another’s enterprise or activities in Section 5; damage to a person’s goodwill or reputation in Section 6; misleading the public arising out of an advertisement or promotion in Section 7; disclosure, acquisition or use of secret information by others without the consent of the rightful holder in Section 8; and discrediting an enterprise arising out of an advertisement or promotion in Section 9. According to this Act, misleading the public with respect to an enterprise or its activities, in particular, the products and services offered by such enterprise, is accepted as an act of unfair competition, and occurs with respect of any of the following: (i) the manufacturing process of a product; (ii) the suitability of a product or service for a particular purpose; (iii) the quality or quantity or other characteristics of products or services; (iv) the geographical origin of products or services; (v) the conditions on which products or services are offered or provided; or (f) the price of products or services or the manner in which it is calculated.
