Resumen

Additional measures to strengthen the fight against corruption in the Republic of Tajikistan is primarily aimed at identification and elimination of conditions conducive to the emergence of corruption, as well as suppressing attempts to create conditions that can lead to corruption. The implementation of such measures in the context of the country's development in the field of further legislative enforcement of countering corruption, improving public administration in socio-economic sphere is becoming an imperative. In order to prevent corruption shall be implemented a set of measures aimed at improving public administration in socio-economic sphere, including: (a) analysis of normative legal acts and introduction of relevant changes and amendments into the Land Code of the Republic of Tajikistan, laws of the Republic of Tajikistan "On land management", "On subsoil" and "On Agreements on Production Sharing", "On Privatization of State property in the Republic of Tajikistan", "On lease", "On mortgage", "On state registration of immovable property and rights thereto" in order to establish clear control and transparency in land matters, real estate transactions, privatization, lease of state property, and the use of state property and state resources; (b) improving the normative legal acts (Law of the Republic of Tajikistan "On State Procurement of Goods, Works and Services and other normative legal acts governing procurement for government needs with a view to ensuring transparency and excluding the possibility of arbitrary interpretation of these normative legal acts, discrimination and granting of unjustified advantages in cases of application of the corresponding normative legal acts; and (c) analysis of legislation and law-enforcement practice to eliminate the possibility of corruption in the field of pension (social security) of citizens of the Republic of Tajikistan (accrual of pensions, temporary disability allowances, maternity benefits, family benefits, unemployment benefits, funeral allowances). The implementation of necessary measures aimed at improving the functioning of state bodies consists of the following: (a) implementation of the rights of citizens to receive reliable information; (b) dissemination of information by making appropriate amendments and additions to the laws of the Republic of Tajikistan "On the Right of Access to Information”, "On state enterprises", "On joint-stock companies", "On limited liability companies” related to restrictions applicable to public servants and persons performing management functions in state organizations or organizations with state share; (c) analysis of legislation (Civil Code of the Republic of the Republic of Tajikistan, the Code of the Republic of Tajikistan on Administrative Offences, laws of the Republic of Tajikistan "On State Enterprises", "On Joint Stock Companies", "On Limited Liability Companies", "On Public Associations" and the Law of the Republic of Tajikistan "On state registration of legal entities and individual entrepreneurs" and the practice of its application in order to prevent and to regulate conflicts of interest in civil service, including application of liability of legal entities in the interests of which corrupt transactions are made; (d) attraction of qualified specialists to civil service and creation of adequate material incentives depending on the volume and results of work; (e) raising responsibility of state authorities, local authorities and their officials for failing to take measures to eliminate the causes and conditions of corruption; and (f) development and introduction of unified standards and job descriptions for the civil service and the optimization and specification of the powers of state agencies and their employees, which must be written in job descriptions.
