A national system of inspection and certification is established to prevent the importation, exportation and spreading of pests and to control or eradicate pests in Canada. Except as permitted under this Act or the regulations, no person shall move, grow, raise, culture or produce any thing that there are reasonable grounds to believe is a pest, that is or could be infested with a pest or that constitutes or could constitute a biological obstacle to the control of a pest. Inspectors are given the power to declare infested places, to enter, inspect, examine and search places or things, and to seize and confiscate things. An owner or operator of an international transportation undertaking may be required by the Minister under this Act to provide and maintain adequate facilities for inspection and other purposes related to the administration of this Act. Disputes over the adequacy of such facilities may be resolved by arbitration. The Act limits the liability of the Government for actions required under the Act or regulations. Payment of compensation is at the Minister's discretion and an appeal process is provided for compensation disputes. Fees, charges and costs may be prescribed for services rendered by the Government under this Act. The Governor in Council is empowered to make additional regulations. Offences under the Act are both general and specific. The evidentiary value of certificates, reports and other documents required under the Act is specified.
