Resumen

The Act makes provision for the prevention of spreading of diseases and pests affecting plants. It consists of 25 articles divided into 6 Chapters: Definitions and general provisions (I); Rules regarding importation (II); Transportation and transit through protected areas (III); Measures affecting cultivation (IV); Penalties (V); Final provisions (VI). The Act is based on the 1951 text of the International Plant Protection Convention. All import of plants, parts of plants, compost and non treated soil, plant packing material, etc. is prohibited, unless allowed by State legislation. The Director of Agriculture, Livestock and Fisheries shall be responsible for the control of importation of plants and plant material. The Minister of Agriculture, Livestock and Fisheries has the power to issue rules regarding phytosanitary certification, import of fruit and vegetables, etc. For protection of plants, an area may be declared a protected area under article 9.
