Resumen This Law is the application of the Convention for the Protection of New Varieties of Plants, 1961, as last revised in Geneva in 1991. It provides for plants breeders' rights and it is divided into fourteen chapters. Chapters One and Two give interpretation and application of the law as concerns both breeders and varieties of new plants. Chapter Three provides for the appointment of a Council, a Registrar, and a breeders' rights Committee, and for their functions (secs. 10-19). Chapter Four provides for breeders' rights registration procedures (secs. 20-30) and deals with publication of application (sect. 22), registration (sect. 24), application for amendment in the Register of Rights (secs. 26-30). Chapter Five deals with the registration of variety denominations, their restrictions and their determination (secs. 31- 35). Chapter Six makes regulations for the protection of breeders' rights (secs. 36-44), their scope and expertise. Chapter Seven deals with the variety bred during or in consequence of service (secs. 45-54). Chapter Eight provides for the duty to indicate the name of the breeder (secs. 55-60). Chapter Nine provides for infringement of breeder's right (secs. 61-70). Chapter Ten makes provision for application by non-residents (secs. 71-73). In Chapters Eleven and Twelve breeder's rights fees are dealt with (secs. 74-81) and penalties for infringements (secs. 82-85). Chapter Thirteen provides for determination of jurisdiction, procedure and practice of law (secs. 86-101). Chapter Fourteen (secs. 102-105) deals with miscellaneous matters such as transitional provisions as concern priority right, the Minister of Agriculture's charge for implementation of this law.
