For the purpose of the Act "invention" means any new and useful art, process, machine, manufacture or composition of matter, or any new and useful improvement in any art, process, machine, manufacture or composition of matter. Section 3 establishes the Patent Office attached to the Department of Industry, or to such other department of the Government of Canada as may be determined by the Governor in Council. The Governor in Council may appoint a Commissioner of Patents who shall, under the direction of the Minister, exercise the powers and perform the duties conferred and imposed on that officer by or pursuant to this Act.
