Resumen

This Regulation consisting of 16 articles provides for the conditions to authorize a Certification and Control Body, as well as establishing its work procedures. It gives the rules to apply to the Director of the Plant Protection and Inspection Services in the Ministry of Agriculture and Rural Development for the authorization as a "Certification and Control Body", and to have a Control Symbol acknowledged. At a first step, it is granted a temporary certification to the applicant, which is given once, and its validity should not exceed 24 months. A permanent certification may subsequently be issued. A Certification and Control Body shall (i) assign a certified organic program for the production and handling of an operator's produce; (ii) permit the operator to use its Control Symbol, through a professional worker only; (iii) provide an annual report of its activities; and (iv) notify about any deviation of a operator from his approved organic program, in the following (1) residues of pesticides in product/produce; (2) use of a substance prohibited for cultivation or production in organic farming; (3) non-permitted use of the uniform organic logo; and (4) marking non-organic produce as an organic one.
