Order No. A-03 of the Minister of Environmental Protection and Green Economy validating the Regulation on public participation in environmental impact assessment.

Resumen

The objective of this Regulation shall be to ensure public participation in environmental impact assessment. Public participation shall be based upon the following principles: (a) dissemination of information and transparency; (b) presentation of project policies, programs and plans; (c) combination of scientific models and quantitative data and comparison with the opinions of stakeholders in order to prevent, mitigate and eliminate potential adverse impacts of the project; (d) stakeholder responsibility for the evaluation of the process; (e) respect for culture, traditions and rights of the local population; and (f) access to publicly available information related to environment, public health, policies, programs, plans and projects. The central government and local authorities in charge of nature and environment shall ensure that the public documents and the environmental impact assessment procedures, guidelines and methodologies required for public participation are open to the public. Public participation in the environmental impact assessment shall be as follows: (a) the professional team entitled to conduct the strategic review shall publicly be informed about public response in relation to environmental impact assessment and shall get feedback within 21 working days; (b) public open discussion on the preliminary findings and recommendations during the strategic review shall be organized by the Ministry of Industry and Trade in line with development policies, programs and plans in collaboration with a team of strategic experts; (c) the professional team responsible for strategic review shall explicate the way in which the discussion was held, how the comments and reviews were incorporated into the report; (d) the team selected for the cumulative impact assessment shall discuss the cumulative impact assessment for local communities and organizations and conduct public hearings; (e) public hearing and open discussion of environmental baseline within the region and its changes; (f) inclusion of comments and recommendations in mitigation measures; and (g) inclusion of the results of public hearing and open discussion in the cumulative impact assessment report.
