Resumen

This Order establishes that natural and legal persons who intend to carry out import, export and re-export of endangered and protected wild fauna and wild flora species covered by CITES convention have the obligation to request the central public authority for environmental protection to issue the import/export permit or the re-export certificate or the certificate required for the movement of live specimens of the animal species or for exceptions to the prohibition of commercial activities by completing the forms established by the European Community legislation on the protection of endangered species. For this purpose, applicants will submit the following documents: (a) the application form, according to the models presented in annexes no. 2-4; (b) copy of the document for payment of the tariff established according to annex no. 9; (c) the data and documents provided for in art. 5-14; and (d) the applicant's registration form, completed according to the model provided in annex no. 7. The central public authority for environmental protection has the obligation to keep a register of the applicants, based on the applicant's registration form. The central public authority for environmental protection may impose special conditions on CITES permits/certificates to ensure compliance with the provisions of the Convention on International Trade in Endangered Species of Wild Fauna and Flora and national legislation on the conservation of biological diversity and animal protection. To obtain the necessary certificate for the movement of live specimens of the animal species the applicant must submit to the issuing authority the following documents: (a) copy of the document certifying his identity; (b) copy of the company registration certificate in the case of legal entities or copy of the authorization in the case of natural persons authorized to carry out activities related to the possession or movement of wild fauna and wild flora species; (c) the written statement regarding the purpose of the change of location for indicated species; (d) in the case of species subject to mandatory registration, proof of their registration; (e) copies of the documents certifying the current location of the species; and (f) the opinion of the competent scientific authority at the place of destination, certifying that the location where the species is intended to be moved is adequately equipped for the preservation and care of the species. Import and transit for commercial purposes of wildlife products of endangered animal species if the importer proves that the products are the result of traditional hunting activities exercised by the Inuit population in accordance with the legal provisions of the country of origin.
