Resumen

This Act sets out a general framework of rules regarding the safety of food, i.e. any article manufactured, sold or represented to be for human consumption, placed on the market in Micronesia and provides for food safety administration. Section 2 sets out the general purpose of food policy and administration and defines the application sphere of the Act. Section 3 contains definitions. Section 4 prohibits the importation, exportation, preparation, packaging or storage of any food that has been imported or will be exported that is unfit for human consumption, adulterated, damaged, deteriorated, or perished. Section 5 defines the adulteration of food. Section 6 prohibits the deceptive representation of food. Section 7 prohibits false labelling of food. Sections 8 to 11 define other requirements regarding the placing on the market of food. The Secretary of the Department of Health Services shall establish a Food Working Group to advise the Secretary and to carry out such functions as the Secretary may assign to it (sect. 11). The Secretary may appoint Food Inspectors and Analysts under section 12. Powers of Food Inspectors are defined in section 13. Sections 14 to 19 prescribe measures of enforcement such as seizure of goods. The Secretary may prohibit the sale of food dangerous or injurious to health pursuant to section 20. Section 24 provides for the licensing of persons to import, export, prepare, pack, store food that has been imported or is being prepared for export, or transport food that has been imported or is being transported for export, according to Regulations promulgated by the Secretary under section 25 of this Act. Section 29 concerns the certification of seafood for exportation. (33 sections)
