Resumen

This Act deals with the establishment of the National Food Authority of Australia (The Authority), its functions, constitution, meetings and staff composition as well as the financial arrangements. The National Food Authority is a corporate body with a certain financial autonomy which may sue and be sued in its corporate name. It is empowered (i) to deal with applications, proposals, drafting and reviewing of food standards; (ii) to coordinate the surveillance by the States, the Territories and any other relevant persons or body of food available in Australia; (iii) to conduct research and surveys in relation to the standards; (iv) to develop food safety education initiatives, assessment policies in relation to food imported into Australia and codes of practice for industry on any matter that may be included in a standard; and (v) to provide advice to the Minister on matters relating to food. To this effect, the Authority may in particular (i) enter into contracts; (ii) acquire, hold and dispose of real or personal property; (iii) occupy, use and control any land or building owned, or held under lease, made available to it; (iv) engage persons to perform services; (v) provide under certain conditions assistance to bodies or persons to prepare submissions relating to the development or variation of standards and to the performance of any other of its functions; and (vi) accept gifts, grants, bequests and advances made to it (whether on trust or otherwise) and act as trustee of money or other property vested in it. The Authority must establish an Advisory Committee, which will advise the Authority on matters referred to it by the Commonwealth, the States and the Territories. It may in addition establish (and abolish) and provide for the organization of committees to assist it in carrying out its functions. An important part of the Act is devoted to the development and variation of food standards. Provisions are made in relation to matters that may be included in standards and variation of standards, and to the objectives that the Authority needs to pursue in developing standards and variations of standards. Special attention must be given (in decreasing priority order) to the protection of public health and safety, to the provision of adequate information relating to food to enable consumers to choose food correctly and to prevent fraud and deception, to promote fair trading in food, to boost commerce in the food industry and finally to support consistency between domestic and international food standards in case they differ, provided the Australian standard is not lowered. Further the Act deals with the application and the proposals by the Authority for the development and variation of standards. Relevant provisions relate to the procedures, for instance the contents of the application, the preliminary assessments, the public submissions, the acceptance/rejection of the application, the conduct of the inquiries, etc., as well as to the drafting procedures and other miscellaneous matters incidental thereto. Finally, the last part of the Act is devoted to matters relating among others to the offences and penalties, where for instance false or misleading information or evidence is provided, to the appeal procedures against decisions of the Authority, to fees for services delivered, to delegation of authority, the Annual Report to be drafted by the Authority, the regulatory powers, etc.
