AN ACT TO REPEAL THE NATIONAL SEEDS ACT, CAP. N5, LAWS OF THE FEDERATION OF NIGERIA, 2004 and enact the national agricultural seeds council to promote and stimulate the development of dependable seed industry, regulate and control the registration of released varieties, protect the farmers from the sales of poor quality seeds, facilitate the production and marketing of high quality seeds in Nigeria and provide legal backing for official testing certification, sales, importation, exportation and use of seed; and for related matters.

Resumen

This Act establishes the National Agricultural Seeds Council as a legal entity and provides for its composition, board and administration. Essentially, the Council functions to; analyze and formulate programme, policies and actions regarding seed development and the seed industry in general, including research on issues relating to seed testing, registration, release, production, marketing, distribution, certification, quality control, supply and use of seeds in Nigeria, importation and exportation of seeds; design improved management system and procedure relating to the administration of seed activity; implement official quality control and certification of seeds, and facilitate enrolment of any approved private body in seed certification programmes; advice the Federal Government on the organisation, management and financing of seed program; approve seed standards ; advise the national research system on the changing pattern of seed demand and farmers' needs; plan, monitor and evaluate the achievements of the national seed system and recommend improvement thereto; encourage the establishment in Nigeria of seed companies for the purpose of carrying out research, production, processing and marketing of seed; issue licenses and permits under this Act; approve policies and strategies to protect all seed producers, local varieties and to promote quality seed production; regulate the seed industry in Nigeria; represent Nigeria and work closely with the West African Committee on Seeds for the development of the seed sector; and to establish and manage a seed sector support fund; among other things. Th Act provides for the appointment of Seed Inspectors who perform functions like taking samples of seed varieties; entering and searching for seed samples in premises, buildings, warehouses, or the likes; sending the seed samples to seed analysts; undertake all inspection necessary to implement and monitor seed production and certification, among others. The Council is to maintain and regularly publish a National Seed Catalogue with a list of released varieties that are eligible for certification in Nigeria. The Council is to also establish the Seed Registration and Release Subcommittee to advise the Council on the establishment and update of the National Seed Catalogue, for registration of seed varieties, and the evaluation of information from National Performance Trials from the compilations of independently conducted trials. The Council is to also establish an official quality control and certification service to certify that the seeds are of acceptable variety or generic purity, in good physiological and health conditions and meet the seed standards as appropriate. Registrations are also extended to the seed producers. The Act prohibits the importation and exportation of seeds without a written authorization from the Council, with measured exceptions, like seeds coming from ECOWAS member States. Importantly, the Council supports research on plant varieties by approving programmes designed to promote genetic improvement of plant varieties and the protection of breeders' rights, and also by participating in the registration of new crop varieties. Also, Council takes adequate measures to protect breeders' rights.
