It provides for the formulation of a county tourism strategy and the establishment of the Council County Local Tourism Council and the Mombasa County Local Tourism Reserve. It also sets out duties of the County Executive Committee Member in respect of tourism and the administration of local tourism related activities and services in Mombasa County taking into consideration the gender dimensions. A beach management program shall be made in relation to all the public beaches in the County. That program shall take into account environmental concerns. The Act prohibits discharge of any dangerous materials, substances or oil into a designated tourism development area contrary to the provisions of this Act or any other law or pollution of wildlife habitats and ecosystems, or discharge of any pollutant detrimental to the environment contrary to the provisions of this Act or any other law. In addition to the fine a court may direct the convicted person to pay the full cost of cleaning up the polluted wildlife habitat and ecosystem and mitigating effects of pollution; and clean up the polluted habitats and ecosystems and mitigating effects of pollution to a third party through adequate compensation, restoration and restitution.
