Ministerial Decree No. 84 validating the Regulation on licensing of special water uses.

This Ministerial Decree regulates licensing of the following special water uses: (a) abstraction and management of over 50 cubic metres of water daily from surface water bodies for agricultural, industrial, energy, fish farming and transport purposes; and (b) water abstraction and water supply to secondary water users. The authorized state water institution shall issue licences for special water uses to the following categories of applicants: (a) enterprises authorized for special water uses in water bodies of special state importance; and (b) foreign legal persons. Licences for special water uses shall be issued to natural and legal persons after coordination with: (a) the territorial branch of the authorized state environmental institution (in all cases); (b) local sanitary and epidemiological bodies (in all cases); (c) the territorial branch of the authorized state veterinary institution in case of water abstraction for stockbreeding and processing animal products; and (d) the territorial branch of the authorized fisheries institution in case of water abstraction for fish farming. Applicants must submit the following documentation to the licensing authority: (a) application containing the name of waterbody, and the place and geographical coordinates of water abstraction; (b) notarized copy of the state registration for legal persons, or the registration certificate for individual entrepreneurs; (c) act of allotment for plots of land for waterworks; (d) waterworks certificate; (e) coordinated terms and conditions of special water uses; (f) certificates attesting qualification requirements of personnel; and (g) copy of the receipt for payment of the licensing fee.
