This Resolution enters into force the day after its publication in the Official Gazette.
Resumen

This Resolution, comprising 13 articles, outlines the following key provisions: (i) The Chief Executive Officer of the Environmental Affairs Agency will lead the restructured Supreme Compensation Committee, tasked with establishing scientific foundations for determining environmental compensation values resulting from activity violations. The committee reviews grievances and adopts estimated compensation values assessed by the Technical Secretariat for Compensations. (ii) The restructured Technical Secretariat Committee for Compensations, now the “Technical Secretariat Committee for Compensations and Grievances,” is led by the Head of the Environmental Management Sector. Serving as an assistant to the Supreme Compensation Committee, it is responsible for tasks such as studying technical reports, estimating initial environmental damage, presenting opinions to the Supreme Committee, notifying concerned parties, receiving and examining grievances, preparing for Supreme Committee meetings, documenting decisions, and coordinating with relevant authorities. The committee also prepares model letters and a grievance model for approval by the Supreme Compensation Committee. (iii) A specialized team, led by the head of the Technical Secretariat and Grievances Committee, is formed to assess environmental damage cases, particularly those from urgent situations and incidents of marine and river pollution involving petroleum oil, derivatives, and harmful substances. The team, including representatives from the Technical Secretariat Committee and a member from the Central Administration for Crises and Disasters, presents its findings directly to the Higher Accreditation Committee.
