Resumen

This Law makes minor amendments to the administrative and legal proceedings related to the operation of mining and quarries. Article 2 of the basic Law is amended by adding the appropriate alphabetical order and the new terms and definitions: such as: "Exclusive economic zone", "Continental shelf", "Regulations", "Convention", etc. Article 4 is amended as follows: (a) by adding immediately the following provisions: "provide that the minerals and quarry, referred to in this paragraph include minerals and quarry materials found in the subsoil of the territorial waters of the Republic, on the continental shelf and the exclusive economic zone» and b) adding the following new subsections 3), 4), 5) and 6): "(3) the rights of control of mining and quarry materials, located in the exclusive economic zone, will be exercised by the Republic in connection with the rights of ownership and control of mining and quarry materials located on the continental shelf. (4) No application for reviewing the authorization, mining lease or quarry privilege in the territorial waters, continental shelf or the exclusive economic zone of the Republic shall be accepted, unless the application is submitted after notification published in the Gazette by the Cabinet. (5) The notice referred determines the following: (6) any permission for quarry survey, mining lease or exploitation may be granted only when the applicant has obtained in advance a positive opinion by the environmental authority, in accordance with Article 11 of the Environmental Impact Assessment Projects Act. Article 11 is amended by making minor changes. Article 14 is amended as follows: (a) the substitution of subsection (1) thereof the following new subsection (1): "(1) The holder overview license has the right to enter and conduct investigations in any land of the Republic and subject to subsection (2), any private land included in the license.» (b) deleting from subsection (2) that the words" and, if not granted such consent without reasonable cause or it is impossible or impractical to obtain, unless they receive special permission of the Cabinet "(third to fifth line). c) by replacing subsection (3) thereof the following new subsection (3), etc.
