These Regulations apply to— a Bermuda NLS ship wherever it may be; and any other NLS ship while it is within Bermuda waters. The Minister may exempt any ship or any description of ship from any of these Regulations (if permitted under Annex II of the International Convention for the Prevention of Pollution from Ships, 1973). The Regulations concern examination and certification of MLS ships by Bermudan surveyors and a Certifying Authority. The owner and the master of an NLS ship must ensure that the condition of the ship and its equipment are maintained to conform with the relevant requirements which apply to the ship, so as to ensure that the ship in all respects remains fit to proceed to sea without presenting an unreasonable threat of harm to the marine environment. The Minister, when requested to do so by a Contracting State other than Bermuda, may cause a survey to be carried out in respect of an NLS ship which is not a Bermuda ship. Ships that are not conform to a NLS certificate shall be subject to corrective action prescribed by a surveyor and if no such action is undertaken, the Certifying Authority may suspend the NLS certificate.
