Resumen

This Act provides with respect to prevention of and response to pollution by ships and declares the International Convention for the Control and Management of Ships' Ballast Water and Sediments, to have the force of law in Papua New Guinea. The Act provides with respect to, among other things: prevention of ship-based pollution by ballast water; exemptions; adequate facilities for the reception of sediments; port surveys and monitoring by the National Maritime Safety Authority with assistance of other authorities; surveys and certification; ballast water management levy; a Ballast Water Management Plan as approved by the Authority for each ship; a ballast water record book for each ship; ballast water and sediment management; duty to report discharges; administration, enforcement, prosecution and jurisdiction. The National Maritime Safety Authority has primary responsibility for the administration and enforcement of this Act.
