Resumen The Act consists of 62 sections divided into 7 Parts: General Provisions (1); Marine Fisheries (2); Pisciculture and Mariculture (3); Protection and Improvement of Marine Fisheries Resources (4); Inspection (5); Penalties (6), Transitional and Final Provisions (7). Marine fisheries, meant by this Act, is the protection, farming and catching of marine fish and other marine organisms as well as extraction of marine plants in Montenegrin marine waters (Art 2). Article 3 allows fishing by foreign organizations and individuals subject to compliance with a Law on Foreign Investments and Concessions. Article 4 defines "commercial fishing" and "sport fishing". Article 5 grants the priority of fishing to whoever arrives first in the fishing area. Articles 7 to 32 contain rules relative to commercial fishing operations. Fishing with driftnets is permitted during all year, except within two miles from the coastland and in the deep-sea over 70 m and the only exception shall be applicated for research purposes in the gulf of Boka Kotorska. Article 10 regulates fishing of small blue fish. Use of dragnets (Art 12) is prohibited during daylight, and a distance of 300 m from other fishing gears must be respected. The use of one or more fishing vessels is permitted for tune fishing, which is open to all tune fishermen (Art 13). The use of baits is prohibited for catching of crustaceans and, for their protection, the competent research institution can set limited fishing zones. The use of fixed nets (Art 15) is permitted during the night provided spearfishing guns are not used. Articles 16 and 17 regulate fishing with small gears. Sport fishing is regulated in articles 20 to 24. The competent Republic authorities shall regulate the allocation of areas for marine fish farming (Part 3). Provisions of Part 4 prohibit the catch of young or undersized fish (Art. 38), provide for the establishment (if necessary) of a closed fishing season (Art. 39); prohibit certain fishing nets (Art. 40) or the changing of mesh sizes (Art. 43). The use of explosives or poisonous substances (Art. 41) as well as spearfishing (Art. 42) is also prohibited. The supervision of the enforcement of provisions of this Act lies with the competent authorities of the Republic of Monte Negro.
