Entry into force notes

The present Act enters into force on 1 April 1998.

Resumen

This Act is divided into 30 sections and regulates the legal practices and procedures of livestock and livestock products in Manitoba. Section 2 states that the director may, cancel or suspend a licence, if in the public interest, or reinstate any cancelled or suspended licence, on any terms and conditions appropriate. There is provision for appeal in section 3. The minister may appoint inspectors; auditors and analysts by virtue of section 4(1). The act outlines the powers of the inspector, including: entry and inspection (sect. 5(1)); and seizure in execution of duties (sect. 6(1)); and search and seizure powers (sec 6(4)); Section 7(1) deals with Storage of seized livestock or things, section 8 highlights disposal of seized livestock and things and section 9 deals with additional duties for inspectors and others. No person shall refuse or fail to admit an inspector demanding to enter in the execution of his or her duty, and no person shall obstruct or attempt to obstruct an inspector in the exercise of any of the powers (sect. 11). Sections 13-19 deal with animal identification, section 20 deals with offences. Livestock transportation requirements are highlighted at section 21. Section 22 states that a person who contravenes this Act or the regulations for which a penalty is not otherwise provided, is guilty of an offence and is liable on summary conviction. Section 25 allows the Recovery of fees, charges or costs incurred in relation to anything required or authorized under this Act. Finally, the minister may make regulations by virtue of section 26(1).
