Resumen

This Law regulates the use of energy from renewable sources, goals of using energy from renewable sources, methods for determining the share of renewable energy sources in gross final energy consumption, integration of energy from renewable sources into the market, incentive systems for electricity production from renewable sources, guarantees of origin electricity, production of electricity from renewable sources for own consumption, use of renewable energy sources in the field of heat and transport, special procedures related to the construction and connection of energy facilities using renewable energy sources, basics of cooperation mechanisms with other countries in the field renewable energy sources, supervision over the implementation of provisions here adopted, as well as other issues of importance for renewable energy sources. The use of energy from renewable sources is in the public interest of the Republic of Serbia and is of special importance for the Republic of Serbia. Regulation of the use of energy from renewable sources includes measures and activities taken to achieve long-term goals, as follows: 1) reducing the use of fossil fuels and increasing the use of renewable energy sources in order to protect the environment; 2) long-term reduction of dependence on energy imports; 3) creation of new jobs and development of entrepreneurship in the field of renewable energy sources; 4) encouraging research, innovation and competitiveness in the field of renewable energy sources; 5) digitalization, simplicity, economy and efficiency of procedures in the field of renewable energy sources; 6) integration of electricity from renewable sources into the electricity market, which includes the exposure of electricity producers to changes in market prices of electricity in order to maximize their market revenues; 7) ensuring the stability of the electricity market, taking into account the costs of integrating renewable energy sources into the system and the stability of the network; 8) regional development related to the use of renewable energy sources; 9) stability of the system of incentives and application of operational state aid in the form of market premium, except for small plants and demonstration projects; 10) awarding incentives through auctions in a public, transparent, competitive and economical manner, without discrimination which ensures a high level of project implementation, except in the case of small plants and demonstration projects when incentives do not have to be awarded through auctions; 11) sustainable and independent development through the maximum use of national scientific-research, technological-development and human capacities in the process of planning to increase the use of renewable energy sources. Power plants that use renewable energy sources are considered to be: 1) hydroelectric power plant; 2) biomass power plant; 3) biogas power plant; 4) wind farm; 5) solar power plant; 6) geothermal power plant; 7) biodegradable waste power plant; 8) landfill gas power plant; 9) gas power plant from a municipal wastewater treatment plant; 10) power plant that uses other renewable energy sources. A reversible hydropower plant is not considered a power plant that uses renewable energy sources. The Government may, at the proposal of the Ministry responsible for mining and energy, with previously obtained opinion of the Ministry responsible for environmental protection, allow works and activities, i.e. projects on construction of a hydropower plant, if it is a project of public and general interest, or projects of special or national importance for the Republic of Serbia. The construction of hydroelectric power plants in protected areas is generally prohibited.
