Resumen This Law establishes legal, economic and organizational grounds for plant protection against pests, diseases and weeds, and is aimed at crop protection. Plant protection shall be based upon the following principles: (a) protection of human health and ensuring environmental security in the process of plant protection arrangements; (b) scientific, ecological and economic substantiation of plant protection arrangements; (c) priority of application of biological plant protection means; (d) transparency and timely submittal of information related to the issues of plant protection. Public competent authority in the sphere of plant protection shall be responsible for: (a) realization of state policy in the sphere of plant protection; (b) registration and classification of particularly harmful pests, diseases and weeds; (c) testing of plant protection means subject to state registration; (d) keeping of state register agrochemicals, including pesticides and fertilizers; and (e) public control in the sphere of plant protection. Article 9 (1) establishes competence of the Plant Protection Service of the Ministry of Agriculture and Environmental Protection of Turkmenistan: (a) implements a unified state policy in the field of plant protection; (b) ensures the development of state programs in the field of plant protection and monitors their implementation; (c) develops, within its competence, regulatory legal acts of Turkmenistan in the field of plant protection and submits it to the authorized body for consideration; (d) determines the types of especially dangerous pests, diseases of plants and weeds; (e) organize testing of plant protection products subject to state registration; (f) provides methodological assistance to legal entities and individuals in carrying out activities using chemical methods, biological agents, mechanical methods of plant protection; (g) maintains the List of chemical plant protection products; (h) develops the procedure for state accounting of plant protection products and submits it to the authorized body for consideration; (i) develop the procedure for testing, storage and use of plant protection chemicals imported into our country for the purpose of using them to protect agricultural plants from diseases, pests, weeds and other agrotechnical measures, and submit it to the authorized body for consideration; (j) exercise state control in the field of plant protection; and (k) resolves other issues in the field of plant protection that are within its competence, in accordance with this Law and other regulatory legal acts of Turkmenistan.
