It states that a trademark is a sign or any combination thereof represented graphically that is capable of distinguishing the goods and/or services of one company from those of another. Trademarks are protected on the basis of their registration with the Sakpatenti or on the basis of international agreements. Well-known trademarks in Georgia are protected without registration, in accordance with Article 6bis of the Paris Convention. A trademark shall be recognised as well-known by the Chamber of Appeals of the Sakpatenti or by a court within the scope of its authority, upon the request of persons concerned.
