This Law applies to: (a) vessels, flying the flag of the Republic of Lithuania, the seas of the Republic of Lithuania and foreign vessels navigating therein; (b) persons performing economic activities in the land and sea area of the Republic of Lithuania, affecting or likely to affect the marine environment; and (c) state and municipal institution with main competence or main functions related to protection of the marine environment. Marine environment shall be intended the living and non-living resources in the sea, above the sea and in the subsoil (air, water, seabed and subsoil and the natural resources thereof). Good environmental status shall be intended the state of the marine environment where under normal conditions marine waters are clean, healthy, vibrant, marine ecosystems are used sparingly and the potential is preserved for future generations. Marine pollution shall be intended the direct or indirect release of substances or energy from human activities, as well as anthropogenic noise from the sea, into the marine environment which causes or is likely to cause adverse effects on living resources and marine ecosystems, including biodiversity loss, and which interferes with or is likely to interfere with activities at sea, including fishing, tourism, recreation and other uses of the marine environment, and impairs or is likely to impair the sustainable use of marine goods and services. Baltic Sea environmental protection measures shall be planned in the national development programs approved by the Government of the Republic of Lithuania. Measures to protect the Baltic Sea environment shall be aimed at: (a) protection of the marine environment, prevention of its deterioration and, where possible, restoration of marine ecosystems in the areas where this environment has been adversely affected; and (b) prevention or reduction of marine pollution by ensuring that there is no impact or significant risk to marine biodiversity, marine ecosystems, human health or the legitimate use of the seas. National development programs in which the protection of the Baltic Sea environment is a set of planned measures that are prepared, organized, coordinated and implemented under supervision of the Ministry of Environment. National development programs which plan measures for the protection of the Baltic Sea environment shall include: (a) assessment of the state of the marine environment; (b) determination of the indicators of good environmental status of the Baltic Sea; (c) establishment of the objectives for the protection of the marine environment; and (d) preparation and implementation of monitoring program for the state of the marine environment.
