Resumen

This Law regulates social relations in the field of protection, management and recovery of disappeared, critically endangered, endangered, vulnerable, rare wild flora and wild fauna species, and wild flora and fauna species with uncertain status listed in the national Red Book, in order to prevent their extinction and ensuring the preservation of their genetic fund; establishes the legal basis for keeping the Red Book, the responsibilities of public authorities at all levels and scientific institutions in this field. The Red Book is an official document that includes a list of disappeared, critically endangered, endangered, vulnerable, rare flora and fauna species and flora and fauna with uncertain status of the Republic of Moldova, as well as general information about their status, condition, habitat, methods of their protection, conservation and distribution. The sphere of application of this Law covers flora and fauna species listed in the national Red Book. The Red Book is the basis for the development and implementation of programs (action plans) for the protection and restoration of flora and fauna species included therein. This Law is based on the following principles: (a) priority of goals and activities for the conservation of flora and fauna species listed in the Red Book; (b) regulation of relations in the field of protection, use and restoration of flora and fauna species listed in the Red Book; (c) compliance with international treaties in the field of protection, use and restoration of flora and fauna species listed in the Red Book; (d) liability of natural persons and legal entities for damage caused to Red Book objects; and (e) mandatory implementation of legislation in the field of protection, use and restoration of flora and fauna species listed in the Red Book. Species listed in the Red Book are public or private property. Species listed in the Red Book located on privately owned land are public property. Legality of the presence of wild fauna and wild flora species listed in the Red Book pertaining to private property is confirmed by relevant documents. This Law contains V Chapters divided into 24 Articles. Chapter I lays down general provisions. Chapter II regards protection and restoration of species listed in the Red Book. Chapter III establishes the procedure for keeping the Red Book. Chapter IV establishes liability. Chapter V lays down final and transitional provisions.
