This Law entered into force on 7 January 2005.
Resumen

This Law regulates relations related to collection, transportation, storage, processing, utilization, disposal, reduction of waste, and other relations connected to this sphere, as well as legal and economic grounds for preventing negative effects on human health and the environment. The effect of this Law extends to the use of industrial waste generated in production cycle (including subsoil management) and consumer waste. The Law does not apply to: (a) radioactive waste; (b) on substances that mix with wastewater and flow into natural watercourses; and (c) on substances emitted to the atmosphere together with gases emitted from emission sources. The main objectives of this Law shall be as follows: (a) elaboration of the basic principles of the unified state policy in the area of waste management; (b) provision of basic conditions, requirements and rules of environmentally safe management of waste, as well as economic incentives for resource-saving activities; (c) guarantee of conditions for generation of minimum quantity of waste, promotion of waste recycling in the business activities, mitigation of adverse effects of waste on human health and environment; and (d) legal regulation of relations in the sphere of waste management. The basic principles of state regulation in the sphere of waste management shall be as follows: (a) protection of human health and environment from adverse effects of waste; (b) guarantee of rational use of raw materials and energy; and (c) balance of public environmental, economic and social interests in the sphere of waste management. In order to protect human health and environment and to reduce the waste volumes as a method of waste prevention, waste disposal quotas shall be set for legal entities and private entrepreneurs involved in the waste management. State waste inventory, classification and certification of waste shall be performed in accordance with the procedure established by the Government. Waste generation, collection, processing, recycling and storage shall be subject to mandatory state registration with annual updating of the database. This Law consists of 8 Chapters. Chapter 1 lays down general provisions. Chapter 2 establishes the competence of state government authorities and local self- government bodies in the sphere of waste management. Chapter 3 regards state regulation, issuance of waste passports, statistical reporting and standardization in the sphere of waste management. Chapter 4 establishes the rights and the liability of entities in the sphere of waste management. Chapter 5 sets forth incentives for waste recycling and reduction of the amount of waste. Chapter 6 deals with supervision in the sphere of waste management. Chapter 7 establishes liability of the infringement of the legislation on waste management. Chapter 8 lays down the final provisions.
