Resumen

This Law, consisting of 66 articles divided into four Chapters and seven Annexes, regulates the administrative procedures for environmental licensing, criteria for classifying activities potentially causing environmental degradation, as well as for remunerating operational costs and analyzing administrative acts (such as: licences, authorizations, waiver certificate) by ADEMA, within the territory of the State of Sergipe, in the form of Annexes I, II, III, IV and V. The services provided by ADEMA and related to environmental licensing, supervision and monitoring activities, together with technical support for the maintenance of federal systems, are regulated in the form of Annexes VI and VII. The construction, installation, expansion, modification and operation of establishments, enterprises, works and activities that use environmental resources, considered as effective or potentially polluting, as well as those capable of causing environmental degradation, are subject to environmental licensing, as provided in Annex I. A List of Activities to be Licensed, classified according to the Degradation Polluting Potential (PPD), are established in specific regulations. The State Environmental Licensing shall be regulated by the State Environmental Council (CEMA) and by ADEMA.
