This Law enters into force on the date of its official publication.
Resumen

This Law defines organizational, legal, economic and social and social frameworks for environmental monitoring in the Republic of Tajikistan and regulates relations among public authorities, local government bodies of settlements and villages, public associations and citizens in the aforesaid field. The subjects of environmental monitoring are: (a) state authorized body to organize and conduct environmental monitoring; (b) local public authorities; (c) self-governing bodies of settlements and villages; and (d) natural resource users. Environmental monitoring data related to environmental information shall not be not subject to classification. Restrictions on access to data related to the need to ensure State secret shall be established by the legislation of the Republic of Tajikistan. Public associations and citizens have the right to apply to the state authorized have the right to apply to the state authorized body on organization and implementation of environmental monitoring to receive reliable and complete information on the state of the environment. On territories with a special ecological status (a zone of ecological emergency, ecological disaster) environmental monitoring is an integral part of programs aimed at rehabilitation of the territories. The Act consists of 5 Sections divided into 22 articles: (1) general provisions; (2) organization of state system of ecological monitoring; (3) competence of the state executive bodies in the sphere of ecological monitoring; (4) regulation of activity in the sphere of ecological monitoring; and (5) conclusive provisions. Ecological monitoring shall be carried out for the following purposes: (a) observation of the state of environment; (b) environmental impact assessment (EIA); (c) access to reliable environmental information. Ecological monitoring shall carry out the following tasks: (a) regular observations of environment; (b) creation of environmental database;(c) forecast of environmental changes; (d) elaboration of programmes, proposals and arrangements for the liquidation of the consequences of negative environmental impact; and (e) informing state bodies, natural and legal persons on the state of environment (Art. 3).
