This Law enters into force one month after the date of its official publication.
Resumen

This Law regulates the relations between the state and natural and legal persons arising from the management of subsoil. It determines the procedure for state legal regulation, the competence of state authorities, local state administrations and local governments, rights and obligations of natural persons and legal entities, as well as responsibility for violation of the legislation of the Kyrgyz Republic in the field of subsoil management. The state implements its subsoil use policy based on the following provisions: (a) the subsoil is the exclusive property of the state under its special protection; (b) discrimination of citizens and legal entities, respectively, on the basis of citizenship or the country of registration is not allowed; (c) tendency to create safe working conditions and preserve safe natural environment; (d) development and management of the mineral resource base of the Kyrgyz Republic; (e) protection and rational use of the subsoil of the Kyrgyz Republic; (f) regulation of relations connected with subsoil use on the basis of mutually beneficial cooperation; (g) transparency, openness of licensing procedures; and (h) prevention of restriction of competition and monopolization in the subsoil use. The Government performs the following plenary powers: (a) manages the State Subsoil Fund; (b) ensures the implementation and improvement of state policy and legislation in the field of subsoil use; (c) determines the subsoil areas and mineral deposits intended to meet state needs in strategic types of mineral raw materials; (d) establishes restrictions and prohibitions on the use of subsoil in order to ensure national security, public safety and environmental protection; (e) approves the list of subsoil areas, deposits of strategic importance; (f) approves the register of subsoil plots of national importance to be put on tender; (g) approves the Regulations on the State Commission on Mineral Reserves of the Kyrgyz Republic (GKZ); (h) approves technical regulations in the field of subsoil use; (h) approves the composition of the Commission for the conduct of tenders for the provision of subsoil use rights and the regulation related thereto; (i) exercises other powers in accordance with this Law and the legislation of the Kyrgyz Republic in the field of subsoil use; and (j) adheres to the international EITI standard. Local government performs the following plenary powers: (a) provides land allotment and the right to temporarily use of land plots for the terms determined by the license in cases established by this Law and the Land Code of the Kyrgyz Republic; (b) performs land allotment for water intake structures with the obligatory consideration of the creation of sanitary protection zones within the boundaries established by the national legislation; (c) ensures unimpeded access of licensees to the licensed area; (d) prevents the unauthorized mining; (e) participates in the liquidation and conservation of mining and other property used in the development of deposits or the geological exploration of subsoil, as well as the recultivation of land; (f) participates in the work of the commissions for the conduct of tenders and auctions for subsoil plots located within the boundaries of the administrative-territorial unit; (g) organizes public environmental impact assessment of subsoil use projects; (h) performs work among the local population in order to prevent unlawful interference with the activities of subsoil users; (i) provides access to social packages and annual reports on their implementation for the local population living in the territory of the administrative-territorial unit on which the subsoil object of national importance is located; (j) keeps a register of individual entrepreneurs for prospecting activities and performs state registration thereof; and (k) exercises other powers related to subsoil use in accordance with this Law and the legislation of the Kyrgyz Republic. This Law is composed of 8 Chapters subdivided into 56 Articles. Chapter 1 lays down general provisions. Chapter 2 establishes plenary powers of state bodies in relation to subsoil management. Chapter 3 establishes the procedure for concession of the right of subsoil use. Chapter 4 regards licensing of subsoil use. Chapter 5 deals with the relations between subsoil managers and land owners. Chapter 6 regards state regulation of subsoil management. Chapter 7 regards dispute settlement and establishes liability for the infringement of legislation on subsoil. Chapter 8 lays dove final and transitional provisions.
