Resumen

This Law is composed of 9 Chapters divided into 43 articles. Chapter 1 gives terms and definitions. Chapter 2 deals with the following legal and administrative measures to be taken in case of a sea disaster: (a) anybody aware of a sea disaster or knowing about a catastrophe happening in the Syrian Territorial Sea shall communicate it immediately to the nearest Harbour Department or to any Official Authority and shall try in any possible way to save and aid the persons involved in the disaster; (b) the Authority, upon receipt of the communication, shall inform the Customs Department, the owner of the affected ship and the consulate of the country to which the ship belongs; (c) the Informed Department shall try in all possible ways to help and save persons without any interference between the Captain and the Crew of the ship; (d) the Department, in order to save and protect the ship, can use all necessary means of transportation and savage, use the force to repress robbery, disorder, confusion and riot and inspect the ship including other ships; (e) the captain of the affected ship shall present to the concerned authority a complete report on the accident; (f) the Authority shall open and start an investigation and inquiry related to the disaster; and, (e) in case the captain is responsible for the accident, the Authority shall arrest the Captain and Crew. Chapter 3 deals with shipwrecks in the port or in anchorages. Chapter 4 deals with measures to be taken with ships at risk. Chapter 5 deals with the measures to be taken against the shipwrecks and ships at risk. Chapter 6 deals with the inquiry, search and towing of shipwrecks. Seeking and looking for goods and things fallen in the Syrian Territorial Sea and ports are dealt with in Chapter 7. Chapters 8 and 9 contain offences and penalties as well as general provisions.
