Entry into force notes
This Law enters into force ten days after the date of its official publication.
Resumen

This Law regulates public relations in the field of aquaculture, use, reproduction, protection of aquatic biological resources, their habitat and fishing in the territory of the Kyrgyz Republic. This Law does not apply to production of aquaculture and fishing facilities in separated waterbodies (ponds, flooded quarries and other artificially created reservoirs), privately owned. Regulation in the field of aquaculture shall be based on the following principles: (a) fishfarming based on the optimal combination of ecological, economic, social, scientific and other interests; (b) ensuring protection, reproduction and sustainable use of aquatic biological resources; (c) payment for the use of fishery reservoirs and aquatic biological resources; (d) scientifically substantiated and rational use of aquatic biological resources in order to obtain stable catches annually and preserve conditions of natural reproduction of aquatic biological resources; (e) participation of civil society in solving issues in the field of aquaculture, use, reproduction and protection of aquatic biological resources, their habitat, development of recreational and sport fishing; (f) participation of fisheries entities in carrying out activities for restoration of the aquatic biological resources used by them; (g) transparency and communication with public organizations and the population in the process of fishfarming; (h) consideration of the natural and socio-economic characteristics of fishery waterbodies and adjacent territories in the planning and creation of cage fishfarms; (h) increasing the reserves and preserving the biodiversity of aquatic biological resources, reproduction of valuable and endemic fish species in waterbodies fishery value; (i) preservation and maintenance of quality and fish productivity in fishery reservoirs used for aquaculture purposes; and (g) long-term and effective use of the allotted reservoirs for aquaculture and fishing. Activities in the field of aquaculture, use, protection and reproduction of aquatic biological resources must ensure compliance with the following requirements: (a) biologically substantiated and sustainable development of aquaculture; (b) prevention of anthropogenic pollution caused by economic or other activities in the field of aquaculture; (c) production of aquaculture by methods preventing damage to the environment, reduction of fish stocks, their quantitative and qualitative composition in waterbodies; (d) prevention of undesirable changes in aquaculture-related aquatic ecosystems aquaculture-related; (e) ensuring protection of allotted waterbodies, fishing areas and fish resources through the creation and maintenance of waterbodies by users of fishkeeping service; (f) development and implementation of annual measures to prevent leakage of fish from the cages into the reservoir and the prevention of emergency situations in the process of operation thereof; (g) keeping fish breeding grounds in proper sanitary condition in places where cage structures are installed, places of keeping, breeding and feeding of aquaculture species; (h) full compensation for damage caused to the ichthyofauna of waterbodies and natural habitat thereof in the process of the performance of fishery activities; (i) rational use of aquatic biological resources to meet the needs of the population for fish products and fishing; (j) submission to the authorized body in the field of fisheries of state statistical reporting on the amount of produced and sold marketable fish and amount of fish grown and released in fishery waterbodies for stock enhancement; and (k) production of aquaculture facilities using non-harmful methods for aquatic biological resources, their habitat and human health. This Law contains IX Chapters divided into 45 Articles. Chapter I lays down general provisions. Chapter II regards allotment for use of waterbodies and aquatic biological resources. Chapter III regards of fishery activity and ownership of aquaculture sites. Chapter IV regards organization of aquaculture activity. Chapter V classifies types of fisheries. Chapter VI regards state protection of fish stocks and natural habitat thereof. Chapter VII establishes economic mechanism of protection and management of aquatic biological resources. Chapter VIII regards international cooperation. Chapter IX lays down final provisions.
