Resumen This Law regulates the environmental impact assessment of public and private projects that may have significant effects on the environment. It shall be applicable to environmental protection through which the conditions and measures for environmental protection are established, which must be respected in the case of the realization of a project, including issuing of building permits, authorization for the use of the land for intensive agricultural purposes, afforestation, water management within framework of the projects “Danube Delta” and “Romanian Waters”. The procedure of EIA consists of the preparation of the report on the impact on the environment by the project owner, carrying out consultations, examination by the competent authority of the information presented in the environmental impact report and any additional information provided, as the case may be, by the project owner, any relevant information obtained following the consultations, and presentation of a reasoned conclusion by the competent authority. The competent authorities objectively fulfill the obligations arising from this law and are not in a situation that generates a conflict of interests. Procedure assessment of the impact on the environment is an integral part of the procedure for issuing the development approval. The environmental impact assessment procedure integrates the appropriate assessment of natural areas protected by community interest, the conservation of natural habitats, flora and fauna, as well as the assessment of the possible effects of industrial emissions and the assessment of the dangers of a major accident in which hazardous substances are involved. Procedure assessment of the impact on the environment is conducted by the central or territorial public authorities for environmental protection, with the participation of the central or local public authorities, as the case may be, which have specific duties and responsibilities in the field of environmental protection. Environmental impact assessment identifies, describes and evaluates, appropriately, for each individual case, in accordance with the provisions of this law, the significant direct and indirect effects of a project on the following factors: (a) population and human health; (b) biodiversity, paying special attention to protected species and habitats; (c) land, soil, water, air and climate; (d) material assets, cultural heritage and landscape; and (e) the interaction between the aforesaid factors.
