Resumen

The Law consists of 12 Sections and 49 articles dealing with the following matters : general provisions (sect. 1, arts. 1-5) ; the state policy in the sphere of potable water and potable water supply (sect. 2, arts. 6-9) ; state management in the sphere of potable water and potable water supply (sect. 3, arts. 10-13) ; economic activity in the sphere of potable water and potable water supply (sect. 4, arts. 14-26) ; standardization and rate setting (sect. 5, arts. 27-30) ; economic mechanism (sect. 6, arts. 31-32) ; sanitary protection (sect. 7, arts. 33-38) ; monitoring and registration (sect. 8, arts. 39-41) ; inspection (sect. 9, arts. 42-45) ; liability (sect. 10, arts. 46-48) ; international cooperation (sect. 11, art. 49) ; final provisions (sect. 12). The present Law establishes legal, economic and organizational basis for the functioning of the potable water supply system with the purpose of ensuring supply of the population with high-quality and safe potable water. The present Law shall be applicable to all economic entities that manufacture potable water, carry out centralised potable water supply or distribution of potable water through mobile sources of water supply, and also to the executive bodies and local self-government authorized to carry out inspection and supervision of water quality standards, the state of water sources, water supply systems, and also water users (art. 2). The objects of legal relations shall be : 1) centralised water supply and water abstraction; 2) rate setting, standardization, licensing and certification ; 3) monitoring, registration and inspection ; 4) protection of water sources and potable water supply systems ; 5) water rights of the users of potable water (art. 5). The state policy in the field of potable water and potable water supply shall be based upon the following principles: 1) state management and regulation; 2) priority of potable water supply with regard to other types of water management; 3) rational use of potable water; 4) compulsory state expertise of the deposits of potable water; 5) licensing of water supply (art. 6). Each water user shall be granted free access to the information regarding water quality. The aforesaid right shall be guaranteed by the state (art. 9). Potable water supply enterprises shall carry out their activity in the presence of the following documents : 1) authorization for special water management or authorization for subsoil management (for the management of groundwater) ; 2) licence for carrying out economic activity regarding water supply and water abstraction ; 3) public authorization for open-ended land tenancy or land ownership ; 4) compliance certificate and resolution of the state sanitary inspection as regards bottled potable water (art. 16). The system of state standards for potable waters hall include: 1) state standard for potable water; 2) state standard for bottled potable water; 3) methods, methodology and means of control and evaluation of potable water quality (art. 27). Restrictions on economic and other activities in zones of sanitary protection. Within the zone of sanitary protection of sources of potable water and objects of centralized potable water supply, economic and other activities are limited. The placement, construction, commissioning, and reconstruction of enterprises, structures and other objects that do not fully meet all requirements and implementation of measures envisaged in the projects of sanitary protection zones , projects for construction and reconstruction, and other projects is prohibited. . Within the first zone, the zone of sanitary protection is prohibited: discharge of any sewage, and also bathing, washing of linen, industrial fisheries and artisanal fishing, grazing, watering of cattle and other kinds of water use, affecting the quality of water; the presence of outsiders, the placement of residential and public buildings, the organization of berths of floating means, the use of pesticides, organic and mineral fertilizers, laying pipelines, mining gravel or sand, dredging and other construction and installation work not directly related to the operation, reconstruction or expansion of plumbing structures and networks; harvesting of timber in the order of cutting the forest of the main use. Within the second zone of the zone of sanitary protection it is prohibited: placement of fuel and lubricants, pesticides and mineral fertilizers, industrial waste water storage, oil pipelines and product pipelines, reservoirs and other high-risk objects that pose a risk of chemical pollution of water; the use of chemicals without the permission of the State Sanitary and Epidemiological Service; placement of cemeteries, cattle mounds, fields of sewage disposal and filtration, irrigation systems, underground filtration facilities, barn storage facilities , silos, livestock and poultry enterprises and other agricultural facilities that threaten microbial pollution of water, as well as the placement of solid waste landfills, biological and sludge ponds; storage and use of pesticides and mineral fertilizers; plowing of land (except for plowing and afforestation), as well as gardening and gardening; drainage and use of permafrost and wetlands in floodplains of rivers; harvesting of wood in the order of cutting the forest of the main use; extraction from the water object of sand and other dredging works not related to the construction and operation of plumbing facilities; arranging summer camps for livestock and grazing it closer than 300 meters from the shore of a water facility (art. 36).
