Resumen

This Law defines legal, organizational and economic bases of public relations when in the process of use of nuclear energy and is aimed at protecting life and human health, environment, property, ensuring the regime of non-proliferation of nuclear weapons, strengthening the international security regime of the use of atomic energy, nuclear and radiation safety and safety in the use of nuclear energy. The main principles of legal regulation in the field of the use of nuclear energy are: (a) ensuring nuclear and radiation safety when using nuclear energy, protection of the population and the environment from radiation hazard; (b) availability, objectivity and timeliness of information related to the use of nuclear energy and the impact on the population and the environment, if this information does not contain information constituting a state secret; (c) return of spent nuclear fuel to the manufacturer; (d) ensuring state verification and supervision of nuclear and radiation safety and nuclear security in the process of the use of nuclear energy; (e) ensuring social protection of the personnel of nuclear facilities; and (f) compensation for damage caused by radiation exposure. The objects of use of atomic energy are: (a) nuclear installations; (b) storage facilities for nuclear and other radioactive materials, storage facilities for radioactive waste, stationary facilities and structures intended for storage or disposal of nuclear and other radioactive materials, as well as spent nuclear fuel and radioactive waste; (c) nuclear materials; (d) spent nuclear fuel; (e) radioactive waste; and (f) sources of ionizing radiation, with indicators above the withdrawal level. State regulation in the field of the use of atomic energy shall be applicable in relation to: (a) licensing of activities related to all stages of the life cycle of the nuclear energy installation; (b) handling of nuclear and other radioactive materials, including the process of exploration and extraction of minerals containing these substances, as well as in the process of manufacturing, use, processing, transportation and storage of nuclear and other radioactive materials, spent nuclear fuel and radioactive waste; (c) conducting scientific research, performing work and providing services related to the use of nuclear energy, including research reactors; (d) physical protection of nuclear installations, storage and disposal facilities for nuclear and other radioactive materials, spent nuclear fuel and radioactive waste; (e) safety and nuclear security in the process of the use of nuclear energy; (f) accounting and control of nuclear materials, sources of ionizing radiation, spent nuclear fuel and radioactive waste; (g) export and import of nuclear materials, technologies and equipment, special non-nuclear materials, materials, technologies and dual-use equipment, sources of ionizing radiation; (h) monitoring of the radiation situation in the territory of the Republic of Tajikistan; (i) transit transportation of nuclear materials and other radioactive materials through the territory of the Republic of Tajikistan; (j) inspection and supervision of the activities of legal entities and individual entrepreneurs in the process of performing work related to the life cycle of nuclear facilities; (k) expertise of nuclear and radiation safety and nuclear security; and (l) training and certification of personnel employed at nuclear energy facilities. This Law consists of VII Sections divided into 35 Articles. Section I lays down general provisions. Section II regards state regulation in the field of the use of nuclear energy. Section III establishes terms and conditions for the activities related to the use of nuclear energy. Section IV regards expertise of nuclear and radiation safety and nuclear security, accreditation of organizations performing expertise of nuclear and radiation safety. Section V establishes rights and duties of natural and legal persons. Section VI establishes guarantees in the field of nuclear energy. Section VII lays down final provisions.
