This Law enters into force on the date of its official publication.
Resumen

This Law regulates public relations related to the management, use and protection of pastures. Boundaries of pastures between pasture users of settlements and villages of the district (city), cities and districts on the territory of one province, districts (cities) and provinces are established with the consideration of the boundaries of administrative-territorial units, livestock, population and functioning farms in a given administrative-territorial unit. The use of pastures is based on the following principles: (a) ensuring effective and integrated use of pastures; (b) accessibility of pastures for individuals and legal entities; (c) control over the use and protection of pastures and the environment to ensure the interests of the state and society; (d) broad participation of the population and public associations in the implementation of measures to protect pastures; (e) transparency of activities related to the use of pastures; (f) attraction of domestic and foreign investments to increase yields and effective use of pastures; and (g) regulation of pastures grazing international cooperation on effective use and protection of pastures. Pastures allocated as seasonal pastures are managed on their territories by local executive bodies of state power, while an authorized state body in the field of forestry manages the lands of the state forest fund. To ensure the management of pastures, the following activities are carried out: (a) state monitoring of pastures; (b) improvement of pastures; (c) state registration of pastures; and (d) environmental audit of pastures. Depending on the purpose, season of use and location, pastures of the Republic of Tajikistan are classified as follows: (a) pastures for cattle driving, rest and sanitary-epizootic measures; (b) winter pastures; (c) spring-summer pastures; (d) summer pastures; (e) permanent pastures; (f) pastures of foothill zones; (g) pastures of mountain zones; and (h) pastures of high mountain zones. The right to use pastures is exercised by individuals and legal entities in accordance with the procedure established by the legislation of the Republic of Tajikistan, and undergoes state registration. A limited right to use pastures may be established with the consent of the parties. In necessary cases, the limited right to use pastures is established on the basis of the decision of local executive bodies of the state power of cities and districts or by court. Pasturelands for use shall be provided at the expense of the lands of the state reserve, state forest fund, populated areas, as well as lands of agricultural purpose according the procedure established by the Land Code of the Republic of Tajikistan. Pastures shall be provided for temporary and open-ended use. The right to use the pasture is terminated in the following cases: (a) improper use of pastures and negative impact on the potential and productivity of pastures; (b) expiration of the pasture use period; (c) regular failure of the pasture user to comply with the established rules; (d) submission of a statement by the pasture user on the voluntary renunciation of the right to use pastures; (e) seizure of land plot of pastures for the needs of the state and society; (f) liquidation of dekhkan (peasant) farms, other agrarian farms, pasture user societies or termination of the activities of natural and legal persons; and (g) in other cases envisaged by the national land legislation. This Law consists of V Chapters divided into 32 Articles. Chapter I lays down general provisions. Chapter II regards state regulation and protection of pastures. Chapter III regards use and lease of pastures. Chapter IV regards protection and improvement of pastures. Chapter V lays down final provisions.
