Resumen This Law regulates the relations arising in the implementation of foreign trade in goods, establishes the legal basis for the application of special protective, anti-dumping and countervailing measures when importing goods. This Law applies to legal relations arising in connection with investigations that precede the introduction of special protective measures, anti-dumping and countervailing measures when importing goods. Anti-dumping measure shall be intended a measure to counter dumping imports, which is applied by decision of the authorized body through imposing an anti-dumping duty, including a provisional anti-dumping duty, or approving voluntary price commitments made by the exporter. Countervailing measure shall be intended a measure to neutralize the impact of a specific subsidy of the exporting country on a sector of the economy, applied by decision of the authorized body through the introduction of a countervailing duty (including a preliminary countervailing duty) or approval of voluntary obligations accepted by the authorized body of the subsidizing country or the exporter. Subsidized import shall be intended import into the customs territory of a country of goods, in the production, export or transportation of which a specific subsidy of the exporting foreign state was used. Introduction of special protective, anti-dumping and countervailing measures for the import of goods must be preceded by an investigation carried out in accordance with the norms of this Law and/or international treaties that have entered into force in accordance with the legislation of the Kyrgyz Republic. The normal value of the goods is determined by the body conducting the investigations based on the prices of similar goods during the investigation period in the domestic market of the exporting foreign state in the normal course of trade, and the buyers are not persons associated with the manufacturer and/or exporter who are residents of that foreign state, for use in the territory of the exporting foreign state.
