This Law enters into force on the date of its issuance.
Resumen

This Law, comprising 16 Articles, aims at establishing the Department of Energy, replacing the Abu Dhabi Water and Electricity Authority and the Regulation and Supervision Bureau for the Water and Electricity Sector. The department aims at (i) providing the best level of services related to the Energy Sector; (ii) advancing the sector and keeping pace with the global developments in this field, by the applicable legislation and in coordination with the competent bodies within the State. It is explained in the Definitions Article that the Energy Sector encompasses all activities, operations, and services related to (a) production, treatment, storage, transportation, distribution, supply, sale, and purchase of gas, oil, and their derivatives; (ii) generation, storage, transportation, distribution, supply, sale, and purchase of all types of electricity (clean, renewable, traditional); (iii) production, treatment, desalination, storage, transportation, distribution, supply, sale, and purchase of water; (iv) collection, treatment, and disposal of sewage and wastewater, as well as the recycling of treated wastewater; (v) production, storage, distribution, and supply of coolant liquid for central cooling applications. The department, under Article 4, is tasked with proposing, overseeing, and implementing strategic plans for the Energy Sector in the Emirate. It monitors and supervises affiliates, regulates the sector through policy development, standards, and licenses for entities in the energy sector. Additionally, it proposes fees, submits reports to the Executive Council, encourages investments and partnerships, and can delegate or outsource its competencies with the approval of the Executive Council. The Chairman of Abu Dhabi Judicial Department will issue a resolution granting law enforcement authority to certain department officers, empowering them to inspect and monitor entities, companies, and individuals in the Energy Sector for compliance with relevant laws, regulations, resolutions, and circulars (Article 8). Engaging in any activity in the Energy Sector in the Emirate is strictly prohibited for any establishment or individual without obtaining the necessary license from the Department, as stipulated by the relevant regulations (Article 9). Articles 10 and 11 provide for offenses and penalties.
