Resumen

Under the Labour Protection Law, there are general obligations of the employer to ensure the health and security of their employees. The costs incurred in the process may not be borne by the employees. Work should be conducted in a way such that the physical and mental health risks for the employees are as low as possible; risks should be mitigated at their source; special dangers for vulnerable persons should especially be considered. The employer is under an obligation to conduct risk assessments. The employer must make sure that only the persons strictly necessary having access to dangerous work areas. Employees have the right to make security suggestions. Fines and criminal sanctions for employers not complying with the regulations and standards are envisaged, these include a fine of no more than twenty-five thousand euros with intentional and negligent contravention of the statutory instruments or a term of imprisonment of no more than one year for any person who persistently repeats an intentional or negligent act or endangers the life or health of a worker on account of an intentional act.
