Governmental Decree No. 546 “On measures for further improvement of the procedure for issuing licenses for the right to use subsoil areas containing non-metallic mineral resources.

Resumen

This Governmental Decree establishes the procedure of electronic auction on the electronic trading platform "E-IJRO AUKSION" for the right to use subsoil areas containing non-metallic minerals, as well as the issuance of licenses for the right to use these areas. The right to use subsoil plots containing non-metallic minerals is granted on the basis of a license for: (a) geological exploration; (b) mining; (c) use of technogenic mineral formations. Licenses shall be issued separately for each type of subsoil use. Licenses shall be issued by the State Committee for Geology and Mineral Resources. The license for the right to use subsoil areas for geological exploration confirms the right to explore, evaluate and assess non-metallic mineral deposits (at the expense of own funds of subsoil users) on the basis of entrepreneurial risk. It is not required to obtain a license for the right to use subsoil areas for conducting at the stage of geological exploration of experimental (test) and pilot production of non-metallic minerals in the volumes justified by design and estimate documentation and sufficient to calculate reserves and assess their quality. The license for the right to use subsoil areas for the extraction of non-metallic minerals gives its owner the right to develop the deposit, process the extracted mineral raw materials, including the use (processing) of technogenic mineral formations obtained in the process of extraction, unless otherwise provided for by the terms of the license. The license for the right to use a subsoil plot for the extraction of non-metallic minerals is issued for the development of the deposit, the reserves of non-metallic minerals on which are approved in accordance with the procedure established by law. The license for the right to use subsoil areas for the use of technogenic mineral formations certifies the right of its owner to carry out processing of waste of mining and processing industries containing non-metallic useful components. The right of ownership of technogenic mineral formations, received in the process of extraction of non-metallic minerals and processing of mineral raw materials in accordance with the license for the right to use a plot of subsoil for extraction of non-metallic minerals, remains with the owner of the license for the period of validity of the right to use a plot of subsoil. In this case, it is not required to obtain a license for the use (processing) of technogenic mineral formations. Subsoil plots for geological exploration, extraction of non-metallic minerals and use of technogenic mineral formations are provided for limited period of time: (a) for geological exploration - for the term up to five years; and (b) for extraction of minerals and use of technogenic mineral formations - for the term of development of a mineral deposit or technogenic mineral formations defined by the technical and economic substantiation. Terms of subsoil use are specified in the license and are calculated from the date of its issuance.
