Entry into force notes
This Governmental Decree enters into force on 9 February 2012.
Resumen

The scope of the “Technical regulation of hygiene requirements for foodstuffs” shall be to establish hygienic requirements and good practices for food chain operators. It shall be based upon the following principles: (a) responsibility of food chain operators for food safety; (b) food safety control at all stages of food manufacturing; (c) provision of refrigeration storage facilities; (d) analysis of hazards and risks and control of critical points at all stages of food manufacturing; (e) determination of microbiological criteria for thermos control of food chain production; and (f) import of foodstuffs in accordance with the requirements of the national legislation complying with the equivalent requirements of the exporting country. Hygienic requirements shall not be applicable to products destined for individual personal consumption, family consumption and homemade foodstuffs. Food chain operators shall, as far as possible, ensure that the original product is protected from contamination, taking into account any further processing thereof. Food chain operators must ensure control of hazardous factors, in particular preventing contamination of foodstuffs by fertilizers, veterinary medicines (drugs) and biocides, control health condition of livestock used for manufacturing of foodstuffs, before slaughtering, in order to avoid risks for human health. Business entities engaged in food production of animal origin must register the following information related to the origin and breeding conditions of livestock: (a) type and origin of feedstuffs; (b) diseases that animals have suffered and veterinary drugs used to cure them; and (c) diagnostics of the state of health of animals destined for slaughtering. Business entities engaged in food production of plant origin must register the following information related to the plant characteristics: (a) application of biocides and plant protection means; (b) cases of diseases and pests that have affected plants; and (c) inspection, examination and assessment of plants through sampling in order to avoid risks for human health.
