Resumen These Regulations implement provisions of the Gene Technology Act 2000. The object of the Act is to protect the health and safety of people, and to protect the environment, by identifying risks posed by or as a result of gene technology, and by managing those risks through regulating certain dealings with Genetically Modified Organisms (GMO's). Regulation 4 defines techniques not constituting gene technology in the sense of section 10 of the Act, whereas regulations 5 defines organisms that are not genetically modified organisms. Part 3 is entitled “Dealing with GMO’s”. It’s provisions deal with licensing (dealings exempt from licensing, application for licence, time limit for deciding an application, prescribed authorities, risk assessment, matters to be taken into account, prescribed conditions of licence), notifiable low risk dealings, and certification and accreditation. Part 4 provides for procedures and composition of the Gene Technology Technical Advisory Committee, whereas Part 5 deals with the Gene Technology Ethics Committee. Regulation 39 prescribes particulars in relation to a notifiable low risk dealing that is notified to the Regulator for purposes subsection 138 (4) of the Act.
