According to section 2, a farmer is not liable in nuisance to any person for a disturbance resulting from an agricultural operation carried on as a normal farm practice. Complaints shall be referred to the Normal Farm Practices Protection Board. In determining whether a practice is a normal farm practice, the Board shall consider the following factors: the effect of the farm practice on abutting lands and neighbours; whether the relevant by-law reflects a provincial interest and, finally, the specific circumstances pertaining to the site.
