Resumen

Family, marriage, motherhood, fatherhood and childhood in the Republic of Tajikistan are under the protection of the state. The legislation of the Republic of Tajikistan on the family is based on the need to strengthen the family, build family relationships on feelings of mutual love and respect, mutual assistance and responsibility to the family of all of her members, the inadmissibility of arbitrary interference by anyone in the affairs of the family, ensuring the unhindered exercise by family members of their rights and fulfillment of duties, the possibility of their judicial protection. Only marriage registered in state bodies of registration of acts is recognized as civil status. Religious marriage does not have legal significance. Regulation of family relations is carried out in accordance with the principles of the voluntariness of the marriage of a man and a woman, equality of rights of spouses in the family, resolving intra-family issues by mutual agreement, the priority of family education of children, care for their well-being and development, ensuring priority protection of the rights and interests of minors and disabled family members. Any form of restriction of the rights of citizens upon marriage and family relations on the basis of social, racial, national, linguistic or religious affiliation shall be prohibited. Property acquired by spouses during marriage, including movable and immovable property, is their joint property. The right to joint property also belongs to the spouse, who during the period the marriage was engaged in housekeeping (domestic work), childcare or for other valid reasons did not have an independent income. A child is a person who has not reached the age of eighteen years (coming of age). Every child has the right to live and be raised and educated in a family. The child has the right to be cared for by parents, ensuring his interests, all-round development, respect for his human dignity. Parents are obliged to ensure that children receive basic general education.
