Resumen

This Law establishes the Enugu State Water Corporation as a body corporate with perpetual succession and a common seal and with the power to sue or be sued in its corporate name and to acquire, hold and dispose of movable and immovable property. Amongst other functions, the Corporation is to develop, conserve and distribute in the State, water for public, domestic and industrial purposes and to charge adequate fees. For the purpose of carrying out this function, the Law bestows certain powers on the Corporation, including the power to construct, reconstruct, operate and maintain waterworks, stations, buildings and other works necessary for the discharge of its functions; to carry water pipes along, through across or under any street, or land, without the constraint of paying compensation to land owners, provided it gives adequate notice to the land owners; to abstract water from natural water resources within the State; to construct public fountains, etc. the Corporation is to be funded by the government, international bodies, and also has the right to borrow money for the carrying out of its projects. This Law also contains extensive penal provisions for any person who causes damage to waterworks and/or causes pollution of water, and related offences.
