Resumen

The present provisions have been enacted in implementation of Legislative Decree No. 351 of 4 August 1999, Legislative Decree No. 152 of 11 May 1999 as well as Legislative Decree No. 372 of 4 August 1999. Particular regard is given to the protection of water against pollution under Part IV. Article 5 (2) defines the competences which are entrusted to the Provincial Council, such as classification of water bodies, identification of areas subject or threatened by drought, soil degradation or desertification, approval of intervention programmes. Surveillance functions and technical and scientific activities shall be carried out by the Provincial Agency for the Protection of the Environment. Articles 7 to 9 regard waste water and water discharges. Article 12 concerns dams. Further, the penalties to be applied in case of violation of the present provisions are laid down in article 13. Part V of the Decree, on the other hand, regards the application of Legislative Decree No. 372 of 1999 concerning the integrated environmental authorization, to be issued by the Provincial Agency for the Protection of the Environment.
