Resumen

This Decree-Law is divided into 5 chapters. Chapter 1 distinguishes two types of fishing vessels: artisanal fishing vessels (whose capacity may not exceed 55 m³, or the relation between motor power and total weight is equal or less than 4 hp per ton) and industrial fishing vessels (all other vessels). Chapter 2 sets forth the modalities for obtaining industrial fishing licences. Applications must be addressed to the competent services of the Ministry of Fisheries. Licences for local industrial fishing may be obtained only after fulfilling the requirements of Port Authorities (art. 2) and upon payment of a fee (art. 6). The transfer of a vessel, from one category to another, may be exceptionally authorized by the Ministry of Fisheries if such vessel satisfies particular requirements (art. 7). Modifications to vessels and their equipment, their ownership or chartering may be requested to the aforementioned authorities (art. 8). To facilitate the organization of fishing resources exploitation, local agents of foreign companies should present a plan concerning their planned operations (art. 10). If no agreement exists between Cape Verde and a foreign company, or between Cape Verde and an inter-governmental organization (with agents in Cape Verde), foreign fishing companies may have an agent in Cape Verde (art. 11). Section 2 deals with artisanal fishing licences and the procedure for obtaining such licences (applications must be addressed to the port authorities of Cape Verde and must contain all the information required concerning the vessel. Licences shall be granted only after compliance with all port authorities' requirements and upon payment of a fee (arts. 13-14). Chapter 3 deals with fishing of lobster, marine turtle and tuna fish and prescribes areas for subsequent regulation (type of bait, fishing nets, reserved areas for artisanal fishing, prohibited areas and underwater fishing). Chapter 4 establishes fish landing conditions. Logistic support to industrial fishing vessels must always be carried out by permit and under the control of the competent authorities. Such a permit must be requested at least 10 days before, by providing all information about the fish caught (art. 20). Non-authorized foreign fishing vessels in transit through the territorial sea, must carry fishing gear which complies with the requirements of article 22. Authorized fishing vessels must always display identification marking and comply with the requirements of article 23. Industrial fishing vessels may be subject of control (art. 24). Vessels entering or leaving the territorial sea of Cape Verde which intend to remain in the territorial sea, must notify it by radio to the port authorities. Every 3 days they must also notify their position and the fish caught (arts. 26-7). Industrial fishing vessels must keep a log-book with all fish caught per species (art. 28). Foreign vessels must always fly the flag of the country in which they have been registered (art. 29). Captains of foreign authorized vessels must permit on board inspection and, if necessary, assist the embarcation and re-entry of such inspectors (arts. 30-31). Chapter 5 lists down offences and penalties contained in Decree-Law No. 17/87 of 18 March 1987.
