Entry into force notes
This Decree enters into force on the day of its publication.
Resumen

This Decree regulates administrative procedures for identification, recognition, delimitation, demarcation and titling of definitive ownership of lands occupied by remnants of the quilombo communities referred to in art. 68 of the Transitional Constitutional Provisions Act. For the purposes of this Decree, the characterization of the remnants of quilombo communities will be attested through self-definition of the community itself. Land occupied by remnants of quilombo communities is used to guarantee their physical, social, economic and cultural reproduction. For the measurement and demarcation of lands, territoriality criteria indicated by remnants of quilombo communities will be taken into account, with the interested community being able to present technical documents for procedural instruction. The Ministry of Agrarian Development, through the National Institute of Colonization and Agrarian Reform (INCRA), is responsible for identifying, recognizing, delimiting, demarcating and titling the lands occupied by the remnants of quilombo communities, without prejudice to the concurrent competence of the States, the District Federal and Municipalities.
