Resumen This Decree-Law consisting of 23 articles aims at (i) encouraging the exploitation and development of renewable energy sources, and benefiting from their applications; (ii) conserving energy through its optimal use of it in various sectors, and contributing to meeting the requirements of sustainable development and protecting and preserving the environment; (iii) encouraging local manufacturing and the use of high-efficiency energy-consuming equipment and renewable energy application systems. The Palestinian Energy and Natural Resources Authority shall have the following powers (i) lay down the energy strategy, national plans, and general policies related to developing the renewable energy sector and improving energy efficiency, reviewing them periodically; (ii) determine the geographical locations in which it is proven that the possibility of exploiting renewable energy sources is available, and determine the priorities for developing these sites; (iii) develop and approve mandatory specifications, standards and technical instructions related to renewable energy sources and energy rationalization systems; (iv) grant licenses to establish, manage, operate and maintain electric power generation projects; (v) prepare proposals for regulations, organizational procedures and means of rationalizing energy consumption and improving its efficiency; (vi) set electrical tariffs, incentive conditions, subscription fees, connection costs allowance, extensions, insurances, and other services related to renewable energy projects; (vii) issue the network code and distribution code and obligate companies to them; (viii) approve energy service companies to carry out energy audits; (ix) issue instructions on the conditions for granting licenses and the conditions for submitting competitive bids; (x) issue instructions for renewable energy projects submitted by a direct offer. The State encourages the establishment of the federation, committees, associations, and professional unions specialized in the energy industry and services, to activate and develop the renewable energy sector, as well as promote the related investment, and improve energy efficiency in Palestine, in coordination with the Energy Authority (art.9). It is not possible to generate electricity to sell without obtaining a generation license granted from the Energy Authority for a specific period to renewable energy facilities in one or more specific sites (art.12). The electric power generated from licensed renewable energy facilities shall be sold under the electric power purchase agreements concluded with the transmission company which is obligated to purchase the entire electrical energy generated on a tariff approved by the Council of Ministers and upon the recommendation of the Energy Authority (art.13). Local councils, the Engineers Association and the Engineering Offices are required to promote and integrate energy conservation and renewable energy practices and their optimal use within design schemes (art.17). To encourage investment in renewable energy, both the renewable energy and energy-efficient equipment and devices are exempted from customs duties, and privileges are granted to the renewable power generation installations (art.18). The Government has the right to allocate public lands or acquire private lands for the purpose of constructing renewable energy plants to produce electricity (art.19).
