This Decree-Law enters into force 30 days after its publication.

Resumen

This Decree-Law amends several provision of Decree-Law No. 344/2007 on the Dams Safety Regulation and approves the Small Dams Regulation. Amendments deal with administrative and legal proceedings, water dam requirements, dam classification, supporting technical documents, competent authorities, etc. Annex II regulates the Small Dams Regulation. The purpose of this Regulation is the safety of small dams during the design, construction, first filling, exploration and rehabilitation phases. This Regulation shall apply to dams less than 10 m. height, measured from the lowest level of foundations up to the height, not taking into consideration the storage capacity of the respective dams as well as those dams size equal or higher than 10 m. and lesser than 15 m, whose reservoirs have the storage capacity equal to or less than 1 hm3. These dams, not covered by the Dams Safety Regulation annexed to Decree-Law No. 344/2007 of 15 October, shall be classified according to the methodology indicated in that Regulation. For dams with a height lesser than 5 m, measured from the basis to the height, in the case of being classified in class III, the provisions laid down in articles 5, 6, 8 and 9 shall be waived. For dams with a height lesser than 2 m. this Regulation shall not apply.
